We have been living in a basement suite for a short while and advised our landlords brother and landlord upon her arrival back from o/s. If we gave the letter for our reason to terminate lease to the brother who picked up the Novembers rent, should it not count to make the 30 days notice eligible? When our landlord heard of our predicament, its like she doesnt believe what we have gone through and that she did threaten to take us to court (and I am scared about). So we are trying to get new tenants into the property to help her out but we still feel like there is a noose around our necks. Plus, my husband has lost his job and pretty much minimal income coming in. We no longer want to stay in the suite and staying with family members, till everything gets better. So I am wondering if breaking the lease agreement is worthy my worries and creating grey hair about?

Legally, I would say your notice to the landlords brother (unless they regularry collect rent, and is your usual contact for financial concerns) would mean little to nothing. I would do whatever you can to sublet the lease. I see it as your obligation otherwise. I wouldn't fret anyhow, what is done is done - you cannot change that nor the fact that you cannot afford to live there now. Everything works out in the long run - don't worry. Good luck.

Your legally bound to the lease agreement you signed. Does the apartment you live in have a C.O. (Certificate of Occupancy)? If it doesn't have one from the city then your lease agreement is null and void. Check with the housing dept. in your city - this may be your only loophole. Good luck.
